From what I've seen, it seems like this tool (and many others) are only available when working with the default agent.
Custom agents have a very limited set of tools: bash, view, skill, report_intent, and it seems there's no way to truly configure it.. Some configurations specified in the .agent.md file are only respected in VS Code, some only in the CLI, and some at both.
Thanks for the report. ask_user hasn't been removed — it's available in regular interactive sessions (see the screenshot earlier in this thread), but it isn't offered when the CLI is started with --no-ask-user, and custom agents that declare an explicit tools list only receive the tools in that list. If it's missing in a normal interactive session with the default agent on the latest version (v1.0.103), please open a new issue with your CLI version and how you started the session. Closing as answered — feel free to reopen if this doesn't cover your case.

It's only available in plan mode I think (?) - would be nice to have it in every mode

it was available in all modes, as it is in VSCode.
But tools get lost so often that I reverted back to VSCode instead of CLI.

Which Copilot CLI version are you using? For me it works and I haven't seen an issue recently.

It's only working within the interactive copilot mode. Could it be that you are in the non-interactive mode?
